ANTI-SPAM POLICY

1. What is Spam?

Spam is commercial email or unsolicited bulk email, including “junk mail”, which has not been requested by the recipient. It is intrusive and often irrelevant or offensive, and it wastes valuable resources. 

Spam messages are the opposite of permission-based email, which are normally anticipated, personal, relevant and/or associated with a pre-existing business or personal relationship. Inappropriate newsgroup activities, consisting of excessive posting of the same materials to several newsgroups, are also deemed to be spam.  

If you must contact thousands of recipients you must do it through permission marketing. A sample of permission  marketing is this: 

1.Prospects see an ad about ways on how to make money online (this is what is called a teaser, where you only state the benefits of the program you are promoting) and you invite them to request more info about it.

2. Then they'd usually fill out a form in a capture page with their personal email and name requesting that you send them more detailed information on your offer. This triggers an autoresponder that will verify that they have asked for the information and once they confirm that, then and only then, they will be instantly redirected to the site of the program you are promoting, in this case eProfitseXtreme site.

3. What is the “Can Spam” law?

Email marketing is super powerful. Unfortunately, many Internet Marketers abused this privilege. Believe it or not, Spam was one of the fastest growing industries online from 1999-2003. The Federal Government has stepped in and is working to end this.

As Legitimate Internet marketers eProfitseXtreme applauds the actions of the US Government with the "Can Spam Act of 2003". All legitimate marketers are seeing an increase response from their marketing efforts, and the ones who had been ruining it for us could get heavily fined.

We have included a run down of this law; advise on how to comply, and our legal disclaimers on this page. We recommend you take the time to read before embarking into any mass mailing promotion. 

Here is a brief run down of the law: 

1) The law became effective Jan 1, 2004. 

2) It prohibits using or falsifying email header information.  

3) It prohibits the use of open relay to "deceive or mislead recipients" about the origin of a commercial email.  

4) It prohibits "harvesting," "dictionary attacks" and "spoofing."  

5) It prohibits commercial email without an unsubscribe process. Either a web link or return email address are acceptable for unsubscribing, you have 10 business days to process removal requests.  

6)  It prohibits automated methods to sign up for free Web-based email accounts. (Like Yahoo or Hotmail)  

7) It prohibits registering for "5 or more" email accounts or "2 or more domain names" with false information and using them to send commercial e-mail messages.  

8) It prohibits sending "sexually oriented material" unless it includes a label to be created by the FTC. And, you don't have to do that if it is opt in. (Violations punishable by up to five years in prison and a $250,000 fine)  

9) The FTC will be producing a report on possible mandated subject line labeling, such as ADV (required in CA) for advertising. As currently drafted, the Can Spam Act requires UCE to carry such information identifying it as an advertisement or solicitation but does not mandate any specific language.4.eProfitseXtreme Spam Restrictions World-wide

Spam laws vary from state to state, and from country to country. This eProfitseXtreme Anti-Spam Policy has been developed to conform to the highest commercially reasonable standards worldwide. As a result, and without limiting the general prohibitions against all spam activities, the following are expressly prohibited:  

(a) Use of false headers, or other false information, to identify the point of origin or the transmission path of the email, or to hide the true origin of the email sender.

(b) Unauthorized use of a third party’s Internet domain name without the permission of such third party, to make it appear that the third party was the point of origin of the email.

(c) Use of any false or misleading information in the subject line of the email.

(d) Assisting any person in using the products or services of eProfitseXtreme for any of these previously mentioned activities.
  
5. Preventing Spam

Customers of eProfitseXtreme's products and services have agreed during their registration process, upon accepting the Terms of Use, to comply with this Anti-Spam Policy. Specifically, each customer agrees not to use the eProfitseXtreme's products or services to send unsolicited bulk email, whether or not for commercial purposes. eProfitseXtreme's maintains the right to determine in its sole discretion what constitutes actionable spam, as well as what measures are necessary in response to such spam activities.  

6. How eProfitseXtreme Helps You to Avoid Spamming

Legitimate Opt in Email Marketing is a powerful tool when it is done legally, ethically, and correctly. Below is some advice to make sure you are compliant with the laws. eProfitseXtreme will be developing its online marketing tools to incorporate a strict permission-based philosophy. This anti-spam philosophy will be implemented through the following: 

(a) Un-subscription – Each email created using eProfitseXtreme products contains an “unsubscribe link”. If your web site visitors use the link to request that they be unsubscribed, your subscriber lists will automatically be adjusted to eliminate the prospect of sending unwanted email to such persons. Additionally, each person on your subscriber list has the option of unsubscribing through a web-based method provided on the eProfitseXtreme web site. Customers of eProfitseXtreme who try to remove the unsubscribe link will be warned that they are doing so, and if they persist in having the link removed or deactivated in any way, then eProfitseXtreme will have the right to terminate their account. 

(b) Purchased Mailing Lists - Mass mailings to purchased email lists are not allowed. eProfitseXtremeonly allows permission marketing as explained above. Similarly, you cannot use an email list relating to particular subject matter, and then use it for an unrelated topic. 

(c) When using your own autoresponder service for promotion - Do research about the autoresponder service you are using to send emails.  Make sure your autoresponder have a removal process that can be handled for you. In addition make sure you will also be able to manually unsubscribe clients who request this from you through email, telephone, or postal mail.

(d) When designing your own autoresponder messages; 
 
d.1) Design subject lines that are clear about the content that is included in the message.

d.2) eProfitseXtreme recommends starting the subject line with ADV: (short for advertising). This is mandatory in California.

d.3) Under no circumstances include adult content with your messages. 5 years imprisonment and $250,000 can be imposed on the first offense.

d.4) Make sure your emails are sent from an email address you will check, and make sure your email reference are set to receive income emails.

Note: Full email boxes will often lead to you being accused as a spammer. Be sure you have a large email box that can handle all of your incoming messages.

eProfitseXtreme has provided here you with guidelines on emailing that meets the new "Can Spam" US laws. You are responsible for understanding and complying with all email laws from your own country of origin, including but not limited to federal, state and local laws.

7. Measures to Enforce the Anti-Spam Policy

Any eProfitseXtreme customer found to be using eProfitseXtreme names, email addresses, products or services for spamming purposes will, at eProfitseXtreme’ discretion, be immediately cut off from use of all eProfitseXtreme products and services with no refund of fees that have been paid.

eProfitseXtreme has the right to actively review its customers’ subscriber lists and email for large broadcasts. If eProfitseXtreme finds any customers to be spamming, it will issue a warning, and if the activities are serious enough, eProfitseXtreme will take action immediately. If eProfitseXtreme has any reason to believe that the customer, despite warning being given, threatens to or is continuing to send spam, then eProfitseXtreme may take action immediately, including disabling the customer’s account. 

eProfitseXtreme does not attempt to censor any content, or to curtail the business of its customers. However, spam activities do not fall within uses authorized by eProfitseXtreme, and will not be tolerated.  Why? because it puts in jeopardy the business for everyone and it stains eProfitseXtreme reputation and name.

8. Reporting Spam

If you believe that you have received spam from or through eProfitseXtreme' facilities, please send a complaint from your email account along with the unsolicited email, with completed header, by using our website support form. Please provide any other information that you believe may help us in our investigation. eProfitseXtreme does not investigate or take any action based on “anonymous” spam complaints. 

NOTE: a person found and confirmed spamming by the hosting company will be terminated immediately and without warning, even to eProfitseXtreme. Many online companies have been shut down by the irrational actions of a member or affiliate!

9. False Spam Complaints

eProfitseXtreme supports the efforts of various organizations working to responsibly eliminate spam activities. However, if an individual has opted-in to receive email from a customer of eProfitseXtreme, and then falsely or maliciously files a spam complaint against eProfitseXtreme or its customers,eProfitseXtreme will cooperate fully with the appropriate agencies to ban the complainant from use of anti-spam software and the Internet community.
